Failure to Blow Charges are a REALLY BIG DEAL

Failure to blow (also called 'Refusal or Failure to Comply With a Breath Demand') charges are a really big deal because by refusing, you deemed to be 'Over 80'  and your life just got very complicated:

  • You may have spent time in a jail cell

  • Your car has been towed and impounded  at your expense

  • Your Driver’s License has been suspended

  • You are liable for a $275 fee to get your Driver's License back

  • You are liable for a $500 administrative fee

  • You are facing Criminal Charges

If convicted (and Failure to Blow charges are very hard charges to beat), you face:

  • A mandatory minimum one-year driving prohibition/suspension for a first-time offender (Judges can impose up to a three-year driving prohibition at their discretion)

  • Mandatory participation and payment for drinking and driving counselling (i.e., the Back on Track Program - Cost Approx. $1,000)

  • Installation of an expensive ignition interlock device in your vehicle (Cost $1,500 - $2,000 per year)

  • Expensive license reinstatement fees

  • A criminal record - impacting employment, credit scores, and travel to the USA forever

  • Skyrocketing auto insurance costs for many, many, many years to come

PLUS - DOUBLE JEOPARDY - YOU CAN STILL BE CHARGED WITH IMPAIRED DRIVING!

If you show obvious signs of impairment when you refuse to blow the police can still charge you with impaired driving, doubling your legal problems.
